1. Agreement to Terms

By accessing or using Prism ("the Application"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Application. Prism is developed, hosted, and maintained by Easy-Cloud.

2. Use of the Application

You are granted a non-exclusive, non-transferable, revocable license to access and use the Application strictly in accordance with these terms. You agree not to use the Application for any purpose that is unlawful or prohibited by these Terms.

3. Intellectual Property

All content included as part of the Application, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Application, is the property of Prism or its creators and protected by copyright and other laws that protect intellectual property and proprietary rights.

"Easy-Cloud" and the "Prism" logo are trademarks belonging to their respective owners. You agree to observe and abide by all copyright and other proprietary notices.

4. Data Responsibility

Prism provides tools for photographers to interact with their clients, including contact forms and future e-commerce features. In these interactions, the Photographer acts as the Data Controller for any personal information collected from their clients.

Easy-Cloud acts solely as a Data Processor, providing the infrastructure and software to facilitate these services. Easy-Cloud is not responsible for the privacy practices, data handling, or legal compliance of any individual photographer using the Application. It is the sole responsibility of the photographer to ensure they comply with all applicable data protection laws (such as GDPR or CCPA) regarding their own clients' data.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Easy-Cloud or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Application.

6. Indemnification

You agree to indemnify, defend, and hold harmless Easy-Cloud, its officers, directors, employees, and agents, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Application, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations.

7. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. Easy-Cloud makes no representations or warranties of any kind, express or implied, as to the operation of the Application or the information, content, materials, or products included on the Application.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You hereby consent to the exclusive jurisdiction and venue of courts in India in all disputes arising out of or relating to the use of the Application.

9. Changes to Terms

Easy-Cloud reserves the right, in its sole discretion, to change the Terms under which the Application is offered. The most current version of the Terms will supersede all previous versions.
